Litigation is, quite simply, the process of resolving conflicts or disputes through the courts. Imagine two people who disagree about something important: a contract that wasn’t honored, a dispute over a piece of land, or a divorce. If they can’t resolve it on their own, they can take the matter before a judge, and that legal process is what we call litigation.
The role of the litigation attorney
Litigation attorneys play a key role. They represent each party in the process and do everything possible to defend their clients’ interests, from building the strategy to arguing before the judge. How the process works
Litigation can seem complicated, but it generally moves through a few stages. It begins with the complaint (demanda), in which one party sets out what happened, presents the evidence supporting their version, and states what they are asking the court for. The other party is then given the chance to respond. Next comes the evidentiary stage, where each side presents documents, witnesses, and expert reports. The judge then issues a ruling (sentencia), which either party may, in many cases, appeal to a higher court.
Litigate or settle?
Not every dispute should go to trial, and not every dispute should be settled. The right choice depends on the strength of your evidence, the amounts involved, and your goals.
